1. INTRODUCTION

These Terms and Conditions (the “Terms”) govern access to and use of the online store www.nanihome.gr, as well as the sale of products and the provision of related services through it.

Please read these Terms carefully before using the website or placing an order. Accessing, browsing and using the website, as well as placing an order, means that you accept these Terms as they apply at the time of website use or order confirmation.

These Terms are supplemented by the Privacy Policy, the Cookie Policy, the Delivery and Assembly Policy and the Returns, Withdrawal and Warranty Policy.

3. SCOPE

These Terms apply to every use of the website, every order placed through the online store and, where relevant, orders or communications made by telephone, e-mail or the Company’s official communication channels when related to NANI Home products or services.

If these Terms conflict with special terms expressly agreed in writing with a specific customer, the special terms prevail only for that particular transaction.

4. USE OF THE WEBSITE

The website and the online store may be used by persons with full legal capacity. Use by minors is permitted only through a parent or legal guardian.

The user must use the website in accordance with the law, good faith, accepted standards of conduct and these Terms. Any use that may harm the operation of the website, system security, the rights of the Company or the rights of third parties is prohibited.

In particular, it is prohibited to send malicious software, gain unauthorised access to systems, interfere with the website’s operation, use false information, infringe intellectual property rights or use the website for unlawful or misleading purposes.

5. USER ACCOUNT

The user may create an account in the online store by providing true, accurate and complete information. The user is responsible for keeping their password secure and for any activity carried out through their account, unless unauthorised use without their fault is proven.

The user must notify the Company immediately in case of suspected unauthorised access to their account. The Company may suspend or disable an account in case of breach of these Terms, suspected or fraudulent activity or use that violates applicable law.

Where a loyalty programme, membership card or similar NANI Home service is available, participation may be subject to specific terms, which are made available to the user before or upon registration.

6. PRODUCTS, DESCRIPTIONS AND AVAILABILITY

The Company makes every reasonable effort to ensure that product information, descriptions, specifications, dimensions, colours, prices and photographs are accurate and up to date. Minor differences may occur, especially in colour shades, due to screen settings, lighting or photographic representation.

Displayed dimensions, materials, technical specifications and other information are based on information available to the Company or provided by suppliers/manufacturers. The customer must check that the product is suitable for their space, intended use and needs before completing the order.

Product availability is displayed on the website or confirmed during the order process. If a product is not available after an order is placed, the Company informs the customer as soon as possible and may propose an alternative product, waiting time, partial fulfilment or cancellation with refund of any amount already paid.

7. PRICES, VAT AND OFFERS

Prices displayed in the online store include the applicable VAT, unless otherwise stated. Any shipping, assembly or additional service costs are displayed or communicated to the customer before order completion or upon confirmation, depending on the nature of the service and delivery location.

The Company may modify prices, products, offers and availability without prior notice. Such changes do not affect orders already confirmed by the Company, unless there is an obvious error in the displayed price or product information.

In case of an obvious error, such as a zero or clearly incorrect unusually low price, the Company may decline to fulfil the order, inform the customer and refund any amount paid.

8. ORDER PLACEMENT

The customer may place an order through the online store by completing the required information and following the checkout steps. Before final submission, the customer can review and correct order details, products, quantity, delivery address and selected payment method.

By placing an order, the customer confirms that the information provided is true and accurate, that they have read and accepted these Terms and that they undertake to pay for the order according to the selected payment method.

9. ORDER CONFIRMATION AND CONCLUSION OF CONTRACT

The electronic acknowledgement of receipt means that the order has been registered in the Company’s system. The sales contract is concluded after the order is confirmed by the Company, in particular by e-mail, telephone communication or another appropriate means.

The Company may contact the customer to confirm details, address, delivery time, availability or other information necessary for proper fulfilment of the order.

The Company may refuse or cancel an order in case of unavailability, inability to contact the customer, failure to complete payment, suspected or fraudulent transaction, obvious error in price or product information, or any other lawful reason. If an order already paid for is cancelled, the amount is refunded to the customer using the same or another legally accepted payment method.

10. PAYMENT METHODS

Available payment methods may include:

debit or credit card payment,
bank deposit or bank transfer,
cash on delivery, where supported,
payment upon delivery in cash or by POS, where supported,
financing or payment in instalments through a partner provider, where available.

Card payments are processed through certified payment service providers. The Company does not store full card details. Where payment through a third-party provider or financing is used, additional terms of the respective provider may apply and are made available before use of the service.

In case of bank deposit or bank transfer, the order may be processed after payment confirmation. Any bank charges are borne by the customer unless otherwise agreed.

11. INVOICES AND TAX DOCUMENTS

The customer may request a receipt or invoice in accordance with applicable tax law. For invoice issuance, the necessary tax details must be provided, such as company name, VAT number, competent tax office where required, business address and any other legally required information.

The customer is responsible for the accuracy of the details provided for issuing tax documents. After the tax document is issued, changes may be made only where permitted by applicable law.

12. ORDER CANCELLATION

The customer may request cancellation of an order before shipment or before the start of special manufacturing, procurement or processing of a made-to-order product. Cancellation requests are reviewed by the Company depending on the stage of the order.

For made-to-order, special-dimension or personalised products, cancellation may not be possible after confirmation and the start of manufacturing or procurement, unless otherwise agreed in writing or required by law.

13. DELIVERY

Delivery terms, service areas, shipping costs and special shipping conditions are described in detail in the Delivery and Assembly Policy.

For deliveries outside Thessaloniki, the transport company is selected by NANI Home, unless otherwise agreed in writing. Delivery times are indicative and may be affected by product availability, delivery location, transport conditions, weather, strikes, force majeure or other factors outside the Company’s reasonable control.

The customer must provide accurate delivery details and ensure that access to the delivery location is possible and safe. If delivery cannot be completed due to incorrect details, the customer’s absence or lack of access, a new delivery date may be required and an additional reasonable delivery charge may apply.

14. RECEIPT AND INSPECTION OF PRODUCTS

Upon receipt, the customer should, where possible, inspect the external condition of packages and products. In case of visible damage, missing items or wrong product, the customer should inform the Company as soon as possible, providing the order number, photographs and a short description of the issue.

Signing for receipt or confirming delivery does not deprive the consumer of their legal rights in case of a defect or lack of conformity discovered later.

15. ASSEMBLY

The assembly service is provided, where available, through NANI Home’s intermediation and is carried out by an external cooperating team engaged by the Company for this purpose. The cost, timing and specific assembly terms are communicated to the customer before or upon confirmation of the service.

The customer must ensure suitable access and working conditions at the assembly location. The Company and the cooperating team may refuse performance or request a new appointment if the location is unsuitable, unsafe or inaccessible.

16. RIGHT OF WITHDRAWAL

A consumer purchasing products remotely through the online store has the right to withdraw within fourteen (14) calendar days from receipt of the products, in accordance with applicable law, unless a lawful exception applies.

The right of withdrawal, exercise procedure, return costs, product return conditions and refund terms are described in detail in the Returns, Withdrawal and Warranty Policy. The customer may also use the Withdrawal Form.

17. EXCEPTIONS TO THE RIGHT OF WITHDRAWAL

The right of withdrawal does not apply, among others, to products made according to the customer’s specifications, made-to-order products, products of special dimensions or clearly personalised products, unless the product is defective or lacks conformity under applicable law.

For health protection and hygiene reasons, products such as mattresses, pillows, mattress toppers and similar items cannot be returned once unsealed after delivery, unless the product is defective or lacks conformity with the contract.

For products that may be returned, the Company may inspect the condition of the returned product. If the product’s value has diminished due to handling beyond what is necessary to establish its nature, characteristics and functioning, the Company may claim corresponding compensation or offset the loss in value against the refund amount, in accordance with applicable law.

18. PRODUCT RETURNS AND PACKAGING

The product should be returned, as far as possible, in its original condition, with all accessories, parts, instructions, documents and original/factory packaging, especially where packaging is necessary for safe transport, identification, hygiene protection or preservation of the product’s commercial condition.

Missing or damaged original packaging, where it is essential due to the nature of the product, may be taken into account during the return inspection and assessment of any reduction in value.

19. LEGAL WARRANTY AND LACK OF CONFORMITY

Products are covered by the legal guarantee of conformity under applicable EU and Greek law. In case of a defect or lack of conformity, the consumer has the rights provided by law.

The legal warranty does not cover damage caused by misuse, improper maintenance, accident, normal wear and tear, improper assembly by the customer or an unauthorised third party, or use contrary to the product instructions.

For warranty claims, defective products, wrong deliveries or missing parts, the customer may submit a request through the Warranty or Complaint Request Form or by e-mail at info@nanihome.gr.

20. MANUFACTURER’S COMMERCIAL WARRANTY

Some products may be accompanied by an additional commercial warranty from the manufacturer or supplier. Where provided, the commercial warranty applies in accordance with the specific terms of the relevant manufacturer or supplier and does not limit the consumer’s rights under the legal warranty.

21. REVIEWS AND RATINGS

Where the website allows reviews or ratings, the user must submit content that is true, lawful and relevant to the product or service. The Company may reject or remove content that is abusive, misleading, irrelevant, unlawful, promotional or infringes third-party rights.

Where reviews are stated to come from verified buyers, the Company takes reasonable measures to check that the review is linked to an actual purchase or customer experience.

22. GIFT CARDS, COUPONS AND PROMOTIONS

Where gift cards, coupons, discount codes or promotional actions are available, the specific terms announced for each case apply. Offers are valid for the stated period, while stocks last or subject to the specific restrictions of each promotion.

The Company may cancel the use of a coupon or promotion in case of abuse, technical error or use contrary to the special terms of the offer.

23. PERSONAL DATA

Personal data is processed in accordance with the Privacy Policy. The use of cookies and similar technologies is described in the Cookie Policy.

24. INTELLECTUAL AND INDUSTRIAL PROPERTY

The website content, including without limitation texts, images, photographs, trademarks, logos, graphics, design, databases and software, is owned by the Company or third-party rights holders and is protected by applicable intellectual and industrial property laws.

Copying, reproducing, distributing, modifying, publicly displaying or commercially exploiting the content without the prior written permission of the Company or the relevant rights holder is prohibited.

25. LINKS TO THIRD-PARTY WEBSITES

The website may contain links to third-party websites. The Company does not control and is not responsible for the content, security, privacy policies or practices of third-party websites. Access to third-party websites is at the user’s own responsibility.

26. TRANSACTION SECURITY

The Company takes reasonable technical and organisational measures for website and transaction security, such as secure communication protocols and cooperation with reliable payment providers. The user must also take their own security measures, such as protecting passwords and using a secure device and connection.

27. LIMITATION OF LIABILITY

The Company makes every reasonable effort to ensure smooth website operation and proper order fulfilment. It is not liable for temporary inability to access the website, technical problems, delays or interruptions caused by force majeure, acts or omissions of third-party providers, telecommunications networks, payment systems or events outside its reasonable control.

Nothing in these Terms excludes or limits mandatory rights granted to consumers under applicable law.

28. FORCE MAJEURE

The Company is not liable for delay or failure to perform its obligations where this is due to force majeure events, such as natural disasters, extreme weather, fires, strikes, war, epidemics, government measures, transport disruptions, serious supply-chain disruptions or other unforeseeable events beyond its control.

29. APPLICABLE LAW AND DISPUTE RESOLUTION

These Terms are governed by Greek and EU law. For any dispute arising from website use or transactions with the Company, the parties will first attempt an amicable resolution by contacting the Company at info@nanihome.gr.

If an amicable resolution is not achieved, the competent courts shall be those determined by applicable law. In any case, mandatory consumer protection rights and the consumer’s right to refer the matter to competent authorities or alternative dispute resolution procedures remain unaffected.

30. CHANGES TO THE TERMS

The Company may amend these Terms at any time by publishing the updated version on the website. Amendments apply from publication unless otherwise stated. Orders are governed by the Terms in force at the time they are confirmed.
